Michael Toner Discusses Possible Link Between Mississippi PAC and Church

Michael E. Toner, co-chair of Wiley Rein’s Election Law & Government Ethics Practice, was quoted in an article published yesterday by The New York Times about potential legal issues concerning a Mississippi political action committee (PAC) and a Mississippi church.

According to the article, the All Citizens for Mississippi PAC appears to share the same address as a local church.  The article further noted that the church’s chief financial officer is also listed as the PAC’s treasurer.  Mr. Toner said that if church resources were used by the PAC it could be “potentially problematic” for the church in terms of maintaining its tax-exempt status.  Mr. Toner also cautioned that people who are associated with churches and other charitable organizations should be careful if they get involved in political activities. 

“The people who are associated with churches, you can be involved in politics, but need to do so in your personal capacity,” Mr. Toner said.  “That’s the dividing line:  Is it in their personal capacity?”
