Michael Toner Discusses FEC Rules Governing Campaign Funds of Deceased Candidates

Michael E. Toner, co-chair of Wiley Rein’s Election Law & Government Ethics Practice, was quoted in an October 6 National Journal article about federal campaign finance rules that govern the remaining campaign funds of deceased candidates.

The funds can be spent in only a few se­lect ways, which are de­term­ined solely by a deceased candidate’s cam­paign treas­urer, according to the article. The campaign committees of deceased candidates also must still file fin­an­cial statements with the Federal Election Commission (FEC) until all of the funds have been spent.

“They un­der­stand can­did­ates can’t take it with them,” said Mr. Toner, a former chairman of the FEC. “Even though you’ve moved on to the next life, your cam­paign com­mit­tee still has re­port­ing ob­lig­a­tions.”
