Overview
Wiley’s Communications Appellate Practice pairs an in-depth knowledge of communications law with administrative, trial, and appellate expertise. The Group is described by The Legal 500 US as “hugely effective” and recognized by Legal Times for its “elite cadre of appellate lawyers” – who regularly appear in federal and state courts throughout the country. Our lawyers are frequently called upon for bet-the-company cases or to take the lead for the industry on a critical issue. We are involved at all stages of litigation, developing new legal arguments, preserving issues for appeal, strategizing the best venue and timing for victory, and ultimately briefing and arguing any appeal. We also regularly file amicus and intervenor briefs, assess the strength of legal challenges, and advise clients about recent legal developments and how they may affect their business plans.
We have successfully represented our clients in a wide range of matters of national significance, including:
- Judicial review of nationally important federal regulatory actions;
- Litigation to accelerate infrastructure deployment and reduce rates for access to poles, towers, and rights-of-way;
- Protection of First Amendment rights, including commercial speech rights;
- Strategic use of preemption arguments to invalidate state and local laws and regulations;
- Class action claims against wireless telephone manufacturers and wireless carriers based on alleged dangers from radio frequency emissions generated by wireless handsets;
- Continuing litigation pitting Internet freedom and privacy against copyright protection in the digital environment of cyberspace; and
- State and federal litigation on issues of cable franchising and cable competition.
