Kimberly Melvin Weighs in on D&O Litigation Resulting from Data Breaches
Kimberly M. Melvin, a partner in Wiley Rein’s Insurance and Litigation practices, was quoted in a Business Insurance article published yesterday about directors and officers (D&O) litigation filed after data breaches at major companies.
According to the article, recent shareholder lawsuits against Target Corp. and Wyndham Worldwide Corp. have other companies examining what their D&O coverage includes in the event of a data breach. Insurers are also taking note and that could result in higher retentions, sublimits, or exclusions.
Ms. Melvin said that the Target breach “put companies on notice of what could happen if appropriate cybersecurity measures are not in place.”
