Roderick Thomas Discusses Supreme Court’s Decision to Hear False Claims Act Case
Roderick L. Thomas, chair of Wiley Rein’s White Collar Defense & Government Investigations Practice, was quoted in a Law360 article published yesterday about the Supreme Court of the United States’ decision to hear a False Claims Act (FCA) case that tests the law's statute of limitations during periods of war. The Court will review the Fourth Circuit’s decision in Kellogg Brown & Root Services Inc. et al. v. U.S. ex rel. Carter. “Under the Carter ruling, the FCA's statute of limitations may never run,” said Mr. Thomas. “There's no telling when, if ever, Congress or the president will formally end the wars in Iraq and Afghanistan—indeed, the Korean War never formally ended.”
