Michael Toner Comments on Obama '08 Campaign Failing to Report Last-Minute Donations

Reuters
April 24, 2012

Michael Toner, co-chair of the Election Law & Government Ethics Practice, was interviewed by Reuters for a story on President Barack Obama's 2008 election campaign failing to properly report nearly $2 million in last-minute donations.  This was the only violation found in a Federal Election Commission (FEC) audit of Mr. Obama's $778 million campaign.

The article reported that election laws require campaigns to “submit notices to the FEC about contributions of $1,000 or more received less than 20 days but more than 48 hours before an election.” The campaign did eventually report the donations in question.

"Overall, this is a very clean audit report for the Obama campaign,” said Mr. Toner, a former FEC chairman.  “The FEC spent two years picking over $750 million in contributions and expenses and found one violation.”
