Megan Brown Weighs In on Call for Pause to Commerce ICT Rulemaking

Megan L. Brown, partner in Wiley’s Privacy, Cyber & Data Governance, National Security, and Telecom, Media, & Technology practices, was quoted in an April 19 Inside Cybersecurity article about industry groups’ call for a pause on an information and communications technology (ICT) supply chain rule issued in January by the U.S. Department of Commerce.

As Inside Cybersecurity reported, President Biden issued an Executive Order (EO) in February, calling on federal agencies to conduct “Sectoral Supply Chain Assessments” on many industrial bases, including the information and communications technology sector. Commerce has continued on a parallel track since the EO was released, despite calls from industry groups to pause the ICT rule issued at the end of the Trump Administration.

Ms. Brown said the Commerce rule would be “better informed” by the results of Biden’s assessments, and therefore the ongoing supply chain rulemaking “should be paused.”
